Supplementing Article 8 (Management of Posts) and Article 9 (Intellectual Property and Copyright) of the Terms of Service, this document explains the procedure and contact methods for a rights holder to notify the Company of an infringement and request that the material be taken down. It does not change the provisions of the Terms or create new rights or obligations, and where anything here could be interpreted differently from the Terms, the Terms prevail.
1. What Can Be Reported
- Content posted on the Site by the Company (writing, images, videos, designs, code, etc.)
- Posts uploaded to the Site by users
- Any part of the materials posted on the Site that you believe infringes your copyright, trademark or other rights
The rights and responsibilities for a post belong to the user who uploaded it (Article 8(1) of the Terms), and the Company may delete a post that infringes the rights of others or restrict its display without prior notice (Article 8(2) of the Terms). This document sets out what the Company needs to check in order to decide on such action.
Requests for deletion based on infringement of rights other than copyright, such as defamation or invasion of privacy, are accepted through the same channel and are handled in accordance with Article 44-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection of Korea.
2. Where to Report
| Inquiry form (recommended) | On the Contact us page, choose the inquiry type "Copyright" → "Copyright Infringement Report". You can attach supporting evidence as files. |
|---|---|
| support@reply.codesand.co.kr (adding [Rights Infringement Report] to the beginning of the subject helps us sort it faster) |
The recipient of requests to suspend or resume reproduction and transmission is the CodeSand Rights Protection Team, and this team handles reports received through the channels above.
Reports are accepted in Korean or English. Replies are sent to the email address provided by the reporting party, and replying to that email continues the same case.
3. What a Report Must Include
If any of the items below is missing, the Company cannot determine whether there is an infringement and will ask for the missing information, which delays the handling accordingly.
3-1. Required Information
- Reporting party's information — name (for a company, its name and the person in charge), address, telephone number and email address
- Whether you are an agent — if you are reporting on behalf of the rights holder, state that fact and your relationship with the rights holder
- Identification of the work claimed to be infringed — information that identifies it, such as its title, the time of first publication and where the original is published
- Location of the infringement — the full address (URL) on the Site. If there are several, please list them all. If it is a particular part of a page, please also tell us which part.
- Nature of the infringement — which right is infringed and in what way
- Statement — a statement that the content of the report is true and that the reporting party is the legitimate rights holder or its agent
3-2. Supporting Evidence to Send with the Report
- Materials proving ownership of the right — copyright registration certificate, trademark register, the first published version, materials showing how the work was created, contracts for the assignment of rights or the grant of a license, etc.
- Materials confirming the infringement — screenshots of the page concerned, materials comparing it with the original, etc.
- If an agent is reporting, materials confirming the delegation
Personal information contained in a report is used only to handle that report and is managed in accordance with the Privacy Policy. The poster is notified of the suspension and its reasons, and the reporting party's personal information is not provided beyond the extent required by law.
4. Handling Procedure
- Acknowledgment — when we receive a report, we confirm receipt to the reporting party by email. We aim to reply within 3 business days.
- Review — we check the required information and supporting evidence. If anything is missing, we ask for it, and handling may be put on hold until it is provided.
- Suspension — if an infringement is confirmed, we suspend the reproduction and transmission of the part concerned without delay (deletion or switching to private). Under Article 8(2) of the Terms, this may be done without prior notice to the poster.
- Notification — we notify the poster of the suspension and its reasons, and reply to the reporting party with the result.
- Record keeping — we keep the report and the handling history in preparation for disputes.
Where it is difficult to determine whether there is an infringement, a deletion request based on defamation or invasion of privacy may be handled by a temporary measure that blocks access for up to 30 days under Article 44-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection of Korea.
5. Requests by the Poster to Resume
A poster who has been notified of a suspension may request that reproduction and transmission be resumed by showing that the posting is based on legitimate rights (Article 103(3) of the Copyright Act of Korea). Requests to resume are also accepted in the same way as 2. Where to Report above, and must be accompanied by the grounds for the request and materials supporting them.
- The Company notifies the reporting party that a request to resume has been received and of the scheduled date of resumption. The scheduled date is set within the period prescribed by applicable laws.
- The Company resumes the reproduction and transmission of the post on the scheduled date.
- However, the post will not be resumed if, before the scheduled date, the reporting party informs the Company that it has filed a lawsuit against the poster.
6. Liability for Reports Without Legitimate Rights
- Anyone who, without legitimate rights, requests the suspension or resumption of reproduction and transmission and thereby causes damage to others must compensate for that damage (Article 103(6) of the Copyright Act of Korea).
- The Company only decides whether to take action based on the materials received, and it is not an authority that finally determines whether a right exists.
- If a dispute between the reporting party and the poster continues, it must be resolved by agreement between the parties or through judicial proceedings.
7. Information for Overseas Rights Holders (DMCA)
The Company is a corporation of the Republic of Korea and this Site is operated in the Republic of Korea, so reports of rights infringement are handled according to the procedure prescribed by the Copyright Act of Korea as described above. The Company has not registered a Designated Agent with the U.S. Copyright Office under the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512).
Overseas rights holders can also report in the same way through 2. Where to Report above. If you send us the following information contained in a DMCA notice as it is, we will accept and review it without any conversion of format.
- The signature (including an electronic signature) and contact details of the rights holder or agent
- Identification of the work claimed to be infringed
- The address (URL) on the Site where the infringing material is located
- A statement of good faith belief that the use is not authorized by the rights holder, its agent or the law
- A statement that the information in the notice is accurate and that the reporting party is the rights holder or its agent
8. If You Want to Use the Company's Content
To copy, transmit, distribute, create derivative works from or commercially use content posted on the Site, you need the Company's prior written consent (Article 9(2) of the Terms). Use within the scope permitted by the Copyright Act of Korea, such as quotation, news reporting, education and research, is possible within that scope, and even then please cite the source.
